1. Contract and services
A contract is formed when we issue written confirmation or begin providing the service. The booking confirmation, these terms, the service description and any accepted written proposal form the contract.
We may refuse, modify, postpone or stop a service where it is unsuitable, unavailable, outside our competence or insurance cover, or presents a safety or data-quality concern. Services are for fitness, performance and educational purposes. They are not medical diagnosis, treatment, physiotherapy or dietetic treatment.
2. Screening and participant responsibilities
The participant must be aged 18 or over, complete health screening honestly and in full at least 24 hours before the appointment, and report any change in symptoms, health, medication, pregnancy status, injury, recent illness, allergies or professional advice.
We may require clinician advice or written clearance at the participant’s cost. Clearance does not oblige us to proceed. Participants must follow preparation, safety and equipment instructions and immediately report chest pain, unusual breathlessness, dizziness, faintness, severe pain or another concerning symptom. Medication must not be changed or withheld unless instructed by the participant’s own prescriber.
3. Informed participation and risks
Some services involve maximal or submaximal exertion. Expected effects may include fatigue, breathlessness, sweating, muscle soreness and temporary discomfort. Less common risks include falls, musculoskeletal injury, fainting, abnormal cardiovascular responses or aggravation of an undisclosed or undetected condition.
Capillary blood sampling may cause brief pain, bruising, bleeding, light-headedness and, rarely, infection. Gait, strength and movement assessments may reproduce existing symptoms. Body-composition and wearable-device outputs are estimates. Participants may ask questions, withdraw consent or stop at any time. Screening reduces risk but cannot identify every condition or eliminate all risk.
4. Prices, payment and packages
Prices are in pounds sterling and include VAT where applicable. The confirmed booking price applies, subject to correction of an obvious error before the service. Payment is due in full at booking through Stripe. We may withhold an appointment or report until cleared payment is received.
Package credits are personal, non-transferable unless agreed in writing, and valid for 12 months unless the booking confirmation states otherwise. Any subscription term, renewal, price change and cancellation method will be shown separately before purchase.
5. Rescheduling, cancellation and non-attendance
Cancel or reschedule through the online booking system or by emailing hello@changeinmotionlabs.com. More than 48 hours before the appointment: no charge. Between 24 and 48 hours: 50% of the appointment price. Less than 24 hours or non-attendance: 100%. Charges will reflect reserved capacity, avoidable costs and our reasonable ability to refill the appointment.
Late arrival may require a shortened or rearranged service and may be treated as a late cancellation where the protocol cannot be completed safely or validly. Exceptional illness will be considered reasonably on the available evidence.
We may cancel or reschedule because of staff illness, equipment failure, unsafe conditions or events outside our reasonable control. We will offer a reasonable alternative or refund for the affected service. Avoidable travel or accommodation costs are not our responsibility unless agreed in writing or required by law.
6. Statutory cancellation rights
A UK consumer contracting online, by telephone or away from our premises will normally have 14 days from the day after the contract is made to cancel, unless an exception applies. Send a clear cancellation statement to hello@changeinmotionlabs.com.
If you ask us to begin during that period and later cancel, you must pay a proportionate amount for work supplied. If the service is fully performed following your express request and acknowledgement, the statutory cancellation right is lost once performance is complete. Valid refunds will be made without undue delay and within 14 days using the original payment method unless agreed otherwise. Statutory rights take priority over the standard appointment policy.
7. Results and reports
We aim to provide reports within three business days after receiving the required data unless otherwise agreed. Results are a snapshot affected by preparation, biological variation, effort, calibration, environment, protocol, software and measurement error.
Recommendations do not guarantee performance improvement, weight change, injury prevention, selection or qualification. Reports are for the participant’s personal use and may be shared with a coach or clinician with appropriate context. A concerning result may prompt advice to seek medical review but is not a diagnosis.
8. Equipment and third-party services
We use specialist third-party equipment and software and will maintain and operate it with reasonable care. No measurement system is error-free. A material technical failure may require a repeat test.
Where failure attributable to us prevents delivery, we may repeat the affected element at no extra charge or provide an appropriate refund or price reduction where repeat performance is impossible or causes significant inconvenience. Third-party platforms may have separate terms and privacy information.
9. Data protection and confidentiality
We process personal data under applicable data-protection law and our Privacy Notice. Performance and health information may be special-category personal data. We collect information reasonably needed for screening, safety, service delivery, reporting and quality assurance.
Identifiable photographs, video, testimonials or case studies will not be used for marketing without separate optional permission. Information may be disclosed where required by law, to protect vital interests in an emergency, or to service providers acting under appropriate safeguards.
10. Intellectual property and permitted use
We or our licensors retain intellectual-property rights in our protocols, explanatory materials, report formats, graphics, scoring methods and general know-how. Once paid for, customers receive a personal, non-exclusive licence to use and share their report for private training, coaching, healthcare, insurance or event purposes.
Reports and templates must not be sold, commercially published, reproduced at scale or stripped of attribution without written permission.
11. Liability
Nothing excludes or limits liability for death or personal injury caused by negligence, fraud, breach of statutory rights that cannot be excluded, or another liability the law does not permit us to limit.
We are responsible for foreseeable loss resulting from our failure to comply with the contract or use reasonable care and skill. We are not responsible for consequences caused by inaccurate or withheld screening information, failure to follow instructions, unauthorised equipment use or use of a report outside its stated purpose, except where our breach or negligence contributed.
12. Conduct, complaints and general terms
We may refuse entry, stop a service or terminate a contract where conduct is abusive, threatens safety, damages property, involves intoxication or seriously breaches these terms.
Raise concerns promptly with Lee Robinson, Director, at hello@changeinmotionlabs.com or 07415 122536. We aim to acknowledge complaints within two working days and provide a substantive response within five working days.
If part of these terms is unlawful, the remaining terms continue. Delay in enforcing a right does not waive it. These terms are governed by the law of England and Wales, while UK consumers retain mandatory protections and rights to bring proceedings in the courts where they live. The terms in force when a booking is confirmed will normally apply.
